Judgment

Petitioner has filed the present writ petition seeking a writ of mandamus directing respondent no.3-District Magistrate, Dehradun to consider and decide the representation of the petitioner dated 27.09.2025, annexed as annexure-12 to the writ petition, whereby petitioner has sought her regularization as a Stenographer in the office of respondent no.4-District Government Counsel (Criminal) Dehradun.
The case of the petitioner is that she has been working as a stenographer on fixed remuneration since January, 2002. She has completed 24 years of service and, as such, claims to be entitled to regularization under the Daily Wage, Work-Charged, Contractual, Fixed Pay, Part-time and Ad-hoc Employees Regularisation Rules, 2013, as amended from time to time, including by the amendment dated 05.12.2025.
Petitioner contends that she is working against the sanctioned post and possesses the requisite qualification for appointment as a stenographer in the regular establishment. Therefore, she claims to have a right to be considered for regularization against the said post on account of her long-standing service as a fixed-pay employee.
Learned counsel for the petitioner submits that petitioner submitted a representation dated 27.09.2025, annexure-12 to the writ petition before respondent no. 3-District Magistrate, Dehradun, but the same has not been decided till date, which resulted into filing of the present writ petition. He further submits that if a direction is issued to respondent no.3 to decide the said representation within a stipulated period, the ends of justice would be met.
Learned State Counsel has no objection if such an order is passed by this Court.
Having considered the rival submissions and having perused the record of the writ petition, the writ petition is finally disposed of with a direction to respondent no.3-District Magistrate, Dehradun, to consider and decide the representation dated 27.09.2025, annexure-12 to the writ petition, strictly in accordance with law, by a reasoned and speaking order, taking into consideration the long-standing service rendered by petitioner on fixed remuneration, within a period of three months from the date of production of certified copy of this order.
Pending application, if any, stands disposed of accordingly.
