By means of present writ petition, petitioner seeks a direction to the respondent authorities to consider and decide the petitioner’s case under Section 27 of the Uttarakhand Annual Transfer for Public Servants Act, 2017 (“the Act”), by duly taking into consideration the spouse policy under Section 17-B(4) of the Act.

Facts, in a nutshell, are that petitioner is working as a Lecturer in Chemistry at Government Inter College (GIC), Gundiyat Gaon, Block Purola, District Uttarkashi. The petitioner is working in the said College since 2013. The husband of the petitioner is a Government Servant, who is working as an Assistant Professor (Physics) in Government P.G. College, Maldevta, Raipur, Dehradun. Respondent No.2 issued a press-note on 15.09.2026 inviting applications for transfer of Lecturers as well as Assistant Teachers (L.T. Grade) under Section 27 of the Act.

The petitioner, pursuant to the said notification dated 15.09.2026, submitted an application for transfer on 21.09.2026 and uploaded the same in the official website/portal/email (educationportal.uk.gov.in). In the said application, petitioner had given as many as six options and she wanted her to be transferred in any of the colleges mentioned in said application.

Learned counsel for the petitioner submits that the respondent authorities may be directed to consider the application of the petitioner under Section 27 of the Act and to take a decision thereon as expeditiously as possible.

Having regard to the facts of the case, the writ petition is finally disposed of with a direction to the respondent authorities to consider the application of the petitioner, submitted under Section 27 of the Act, strictly in accordance with law, and to consider transferring the petitioner to any of the colleges mentioned in the application submitted by her.

Pending application, if any, stands disposed of.
