Judgment

This is an application filed under Section 482 of the BNSS, 2023 for granting anticipatory bail to the accused-applicants in connection with Dharmanagar Women PS case No.23 of 2024 registered under Sections 85/80/3(5) of the BNS Act, 2023.
Heard Mr. Pujan Biswas, learned counsel appearing for the accused-applicants. Also heard Raju Datta, learned PP appearing for the State-respondent.
Taking note of the post-mortem report and the allegations levelled in the complaint lodged by the complainant, prima facie, I am of the view that the matter requires more investigation about the cause of death of the deceased wife of Jabbar Miah, accused-applicant no.4 herein. Post-mortem report does not show that just before her death, she was subjected to physical torcher. There is ligature mark on the neck of the deceased who died out of hanging.
In this circumstance, I am inclined to grant anticipatory bail in favour of the accused-applicant no.4, i.e. Jabbar Miah.
Accordingly, it is ordered that in the event of arrest, the accused-applicant no.4, namely Jabbar Miah shall be released on bail by furnishing a bond of Rs.50,000/- (Rupees fifty thousand) with one surety of like amount to the satisfaction of the arresting authority.
However, it is directed that the accused-applicant no.4, i.e. Jabbar Miah shall appear before the Investigating Officer once in a week and he will cooperate with the process of investigation in all respect.
In terms of the above direction, the instant anticipatory bail application stands allowed and disposed.
