Judgment

Heard Mr. S. Lodh, learned counsel appearing for the applicant. Also heard Mr. S. Ghosh, learned Addl. P.P. appearing for the respondent-State.
This is an application filed by the applicant under Section 439 of CrPC for granting bail to the accused, namely, Rajib Munda who has been arrested in connection with Bodhjungnagar P.S. Case No.2023 BJN 050 on 18.07.2023, registered under Sections 420/376(2)(n)/343 of IPC.
In terms of the order passed yesterday, i.e. on 29.09.2023, Mr.Ghosh, learned Addl. P.P. has produced the case diary.
I have perused the case dairy and on perusal of the same, prima facie, I find nothing material which reveals that the accused had raped the victim on misrepresentation of facts. However, this observation may not be taken into account at the time of trial. This is a prima facie view of this Court.
It is submitted that on 29.09.2023, the accused Rajib Munda was released on interim bail on furnishing a bail bond of Rs.25,000/- (twenty five thousand) with one surety of like amount to the satisfaction of jurisdictional Magistrate. Hence, I direct that the accused Rajib Munda shall be released on regular bail on the strength of previous bail bond.
Accordingly, the order dated 29.09.2023 is hereby made absolute. With the aforesaid directions and observations, the instant bail application stands allowed and disposed of.
