Judgment

The petitioner, who is working as Naik/GD at Medical Training Centre Shimla, and is under transfer to 4th Battalion, SSB Lucknow, has come up before this Court seeking cancellation of the impugned order of transfer Annexure P-1, on the medical ground.
Notice. Mr. Shashi Shirshoo, learned Senior Panel Counsel appears and waives service of notice on behalf of the respondents.
Learned counsel for the petitioner submits that the petitioner and his wife is suffering from HIV. Learned counsel further submits that the petitioner would feel satisfied, in case a direction is issued to the respondents to consider the representation of the petitioner sympathetically.
In view of the nature of the order, we propose to pass, no response is required from the respondents.
Given the factual matrix of the case, this petition is disposed of with a direction to the respondents to decide the representation Annexure P-3 of the petitioner and pass appropriate orders within one week. We hope and trust that the respondents shall consider the representation with a sympathetic view as the petitioner and his wife are suffering from HIV. Till the decision of the representation, the operation of the impugned order Annexure P-1, shall remain stayed. Pending application(s), if any, are closed.
