This is the second journey of the petitioner to this Court praying for bail in Special G.R. Case No. 68/328 of 2018-20 pending in the Court of learned Additional Sessions Judge (FTSC), Sambalpur which arises out of Jujumura P.S. Case No. 158 of 2018 for commission of offences punishable under Sections 376 DA/ 354/ 294 of IPC and Section 6 of the POCSO Act, 2012 and under Section 3 (2) (v) of SC/ ST (PoA) Act.
Issue notice to the Respondents.
Notice on behalf of respondent no.1 is accepted by Mr. D. Biswal, learned Additional Standing Counsel. Requisites for issuance of notice on respondent no.2 by Registered Post with A.D shall be filed by 17.04.2023. The notice shall be made returnable within three weeks.
Copy of the appeal memo be served on Mr. D. Biswal, learned Additional Standing Counsel, for service of notice on respondent no.2 through the I.O./I.I.C., Jujumura Police Station, who shall also inform the respondent no.2 about the date of the posting of the case and that he/she can appear in the case through counsel or in person through video conference from the Jujumura Police Station to oppose or support the prayer for bail. Written endorsement and instructions regarding service of notice and intimation shall be produced by the learned State Counsel on the next date.
