Judgment
Heard Sri.Abdul Majidh Khan, learned counsel appearing for the petitioner and Sri.Jagadeesha.B.N., learned Special Public Prosecutor appearing for the respondent.
The petitioner is the sole accused in the FIR registered by the respondent-Anti-Corruption Bureau in their crime No.4/2017 in respect of offence punishable under Section 7 of the Prevention of Corruption Act, 1988.
The allegation is, the petitioner, who is working as a Member Secretary, Puttur Urban Development Authority placed demand for gratification of Rs.20,000/- to effect conversion of agricultural land belonging to the complainant.
On the complaint lodged by the complainant with the respondent, the case was registered, trap was laid by the Investigating Officer and the tainted currency notes were seized from the possession of the petitioner and she was arrested.
Sri.Abdul Majidh Khan, learned counsel for the petitioner submits that the petitioner is in custody from 12.04.2017. Major portion of the investigation having been complete, the petitioner is ready to abide by any conditions imposed by this Court. Hence, she may be enlarged on bail.
Sri.Jagadeesha.B.N., learned Special Public Prosecutor opposes the petition.
Having noticed that major portion of the investigation was completed immediately after the trap, there is no impediment to allow this petition.
Accordingly, the petition is allowed. The petitioner is enlarged on bail in Cr.No.4/2017 registered by the respondent-Anti Corruption Bureau on the following conditions:
i) The petitioner shall execute a self bond for a sum of Rs.50,000/- with one surety for the likesum to the satisfaction of the concerned Court.
ii) She shall co-operate with the Investigating Officer during the further course of investigation.
iii) She shall not threaten the complainant.
In view of allowing of the petition, I.A.No.1/2017 does not survive for consideration. Hence, I.A.No.1/2017 is disposed of.
