Judgment

The proposed First Appeal has been filed against the judgment and decree dated 22.04.2024, passed by learned Senior Civil Judge, Haridwar in Original Suit No.190 of 2018, by which, the learned Court has dismissed the said Original Suit, filed by the proposed appellants – plaintiffs for perpetual injunction.
Ms. M.S. Sadaf, learned counsel for the appellants and Mr. Nikhil Singhal, learned counsel for the respondents.

The present matter was referred to the Mediator.
The report of the Mediator Lata Negi, Advocate dated 03.09.2024 is available on record. As per the report of the Mediator, the mediation proceedings (Mediation Case No.128 of 2024) are closed as successful.
Smt. Lata, appellant no.1 and Smt. Rachna, appellant no.2 are present in-person.
Respondent No.1-Dinesh Kumar Chauhan and Respondent no.3-Vineet Kumar Chauhan, are present in-person.
Both the parties submitted that they have settled their disputes with their free will and without any pressure. They have requested to decide the present First Appeal on the basis of the terms and conditions as mentioned in the Settlement/ Agreement, recorded by the mediator in Mediation Case No.128 of 2024.
With the consent of both the parties, the present First Appeal is decided on the terms and conditions as recorded by the Mediator.
The judgment and decree dated 22.04.2024, passed by learned Senior Civil Judge, Haridwar in Original Suit No.190 of 2018 are modified accordingly.
The Settlement/Agreement, recorded by the Mediator Lata Negi, Advocate in Mediation Case No.128 of 2024, will form part of the decree.
The Registry is directed to draw a decree accordingly.
