1.The matter is taken up through hybrid mode.
Heard Mr. S.K. Dwibedi, learned counsel for the Petitioner and Mr. K.K. Das, learned Additional Standing Counsel.
It is submitted that in the meantime though 10 witnesses have been examined on behalf of the prosecution but the victim is not one among them. It is further submitted that despite the victim has come to the court in more than one occasion, still she is not examined by the prosecution deliberately.
In a trial involving offence under Section 376 I.P.C., the evidence of the victim is important.
Learned trial court, i.e. learned Additional Sessions Judge, Balliguda is directed to submit a report in S.T. Case No.54 of 2020 stating the stage of trial and the names of witnesses so far examined in course of trial.
Registry is directed to get the report before the next date.
List the matter on 29th September, 2022.
The copies of depositions filed by Mr. Dwibedi are kept on record.
