Learned counsel for the petitioner submits that the petitioner is a retired State Government employee and has filed the present writ petition seeking a direction to the respondents for correction of his pension/TDS records on account of erroneous uploading of Form-16 for the financial year 2025-26 instead of 2026-27. He further seeks a direction for stoppage of deduction of Rs.17,029/- per month from his pension towards TDS.
Learned counsel for the petitioner submits that the aforesaid amount is being deducted from his pension due to erroneous uploading of Form-16 for the financial year 2025-26 instead of 2026-27.
Perusal of the records shows that on the previous date of hearing, learned State counsel was directed to seek instructions regarding the basis of such deduction.
Today, on instructions, learned State counsel has placed before this Court the communication dated 30.09.2026 issued by the Principal, Government Higher Secondary School, Baria, District Sarangarh-Bilaigarh, to the District Education Officer, Sarangarh-Bilaigarh. Learned counsel appearing for the Bank has also placed on record the communication dated 30.09.2026 issued by the District Treasury Officer to the Branch Manager, State Bank of India. Both the documents are taken on record.
From the aforesaid communications, it is apparent that Form-16 for the financial year 2025-26 was inadvertently uploaded instead of Form-16 for the financial year 2026-27, resulting in deduction of TDS of Rs.17,029/- per month from the pension of the petitioner. It has further been stated that the tax for the financial year 2025-26 has already been deducted and the concerned Branch Manager has been directed to ensure deduction of tax in accordance with Form-16 for the financial year 2026-27.
I have heard learned counsel for the parties and perused the material available on record.
In view of the aforesaid submission of the respondents and also considering the communications dated 30.9.2026, the present writ petition is disposed of with a direction to the concerned respondents not to deduct TDS of Rs.17,029/- per month from the pension of the petitioner. It is further directed that, if any amount has already been deducted from the pension of the petitioner on account of the aforesaid error, the same shall be refunded to the petitioner within a period of 50 days from the date of receipt of a copy of this order.
With the aforesaid direction, the writ petition stands disposed of.
