Judgment
B.S. Verma, J.—Heard Mr. Lalit Sharma, learned Counsel for the Petitioners, Mr. Kailash Tewari, Brief Holder on behalf of Respondents 1 and 2, and Mr. T.A. Khan, Advocate for Respondent No. 3.
By means of this petition the Petitioners have sought the following relief-
(1) to issue a writ, order or direction in the nature of certiorari to consider the claim of the Petitioners for payment of wages according to the rates fixed by Third Wages Board with effect from the date the Petitioners are serving in the department after taking into consideration the fact that other similarly situated incumbents are being paid wages according to the rates fixed by the Third Wages Board in compliance of the order dated 29-08-1995 passed by the Respondent No. 2 and the subsequent judgment and order dated 05-09-2005 passed by this Hon''ble Court whereby the order dated 29-08-1995 has been confirmed.
(2) to issue a writ, order or direction in the nature of mandamus commanding the Respondents to make the payment of arrears with interest in respect of the revised wages as fixed by the Third Wage Board.
(3) to issue a writ, order or direction which this Hon''ble Court may deems fit and proper in the facts and circumstances of the case.
During the course of argument, learned Counsel appearing on behalf of the Petitioners, has submitted that for redressal of their grievance the Petitioners have preferred a representation before Regional Deputy Labour Commissioner, Kumaon Region, Haldwani District Nainital (Annexure No. 2 to the writ petition), and the Respondent No. 3, may be directed to decide the representation by a reasoned and speaking order. Prayer made is innocuous.
The Respondent No. 3, Executive Director of M/s Kichha Sugar Company, Kichha, District Udham Singh Nagar, is directed to decide the representation of the Petitioners by a speaking and reasoned order within a period of eight weeks, from the date of production of certified copy of this order as well as the copy of representation before Respondent No. 3. The Petitioners are directed to also file copy of representation before Respondent No. 3, along with certified copy of this order.
With the above direction, the writ petition is disposed of finally.
