Judgment
Petitioner has filed this petition under Article 226 of the Constitution of the India seeking first regular parole for 20 days.
Learned counsel for the petitioner has submitted that the petitioner had filed application for first regular parole for 20 days before the District Parole
Advisory Committee, Bharatpur but the Committee vide order dated 29.5.2020 arbitrarily dismissed the application of the petitioner, whereas, jail
conduct of the petitioner is found satisfactory and his behavior is also good. In reply, it is admitted that conduct of the petitioner is satisfactory and he
has consumed 5 years 11 months and one day of his total sentence.
Learned State counsel has opposed the petition. Keeping in view the facts and circumstances of the case and contentions put forth, it would be just
and expedient to order the release of the petitioner on first regular parole.
Accordingly, this petition is allowed. Petitioner be released on first regular parole for twenty days subject to the satisfaction of the respondent No.3.
