The present petition has been filed under Section 482 of the Code of Criminal Procedure for quashing of the complaint under Section 42(5) of Food Safety & Standards Act, 2006 dated 31.08.2016 (Annexure P-3) along with notice of accusation & order dated 18.07.2017 (Annexure P-8) passed by SDJM, Moonak and order dated 10.12.2018 (Annexure P-11) passed by Addl. Sessions Judge, Sangrur.
Reply by way of affidavit of Food Safety Officer, presently posted at Bathinda, District Bathinda has already been filed on behalf of the respondent, which is taken on record.
At the outset, Mr. H.S. Sitta, learned DAG, Punjab has stated on specific instructions that the present petition has become infructuous in view of the fact that the petitioner has since been convicted by the learned trial Court on 27.03.2023.
In view of the statement made by the learned State Counsel, the present petition is disposed of as having been rendered infructuous.
Since the learned counsel for the petitioner is not present today, liberty is granted to the petitioner that in case any cause of action survives, then an appropriate application can be filed in the present case.
