Judgment
ORDER
The revision petitioner is the decree holder who has filed EP No.1 of 2026 on the file of District Munsif cum Judicial Magistrate Court, Uthukottai. The present revision petition has been filed seeking expeditious disposal of EP No.1 of 2026 within a particular time frame.
The grievance of the petitioner is that despite the suit having been filed way back in the year 2007 and decreed on 04.07.2023 and the appeals preferred therefrom also ending in favour of the petitioner on 18.12.2025 and further Second Appeal in S.A.No.255 of 2026 also being dismissed on 07.04.2026, the petitioner is unable to see the colour of the coin and enjoy the fruits of the decree granted way back in July 2023.
In view of the recent decisions of the Hon'ble Supreme Court in Periyammal (Dead Thr. Lrs.) vs V. Rajamani and Anr. etc, reported in, 2025 (2) CTC 404 and Rahul S. Shah v. Jinendra Kumar Gandhi, reported in AIR 2021 SC 216, the Executing Courts are directed to dispose of all execution petitions within a period of six months.
In the light of the above, I am inclined to dispense with notice to the respondents, since no serious prejudice will be caused to the respondents by issuing suitable directions for expeditious disposal of the Execution Petition.
Accordingly, the District Munsif-cum-Judicial Magistrate, Uthukottai shallo dispose of EP No.1 of 2026 on merits and in accordance with law on or before 30.11.2026.
With the above direction, the civil revision petition is allowed. No costs.
