Judgment
The present petition has been filed seeking to set aside the summons issued by the respondent herein on 15.07.2026, directing the petitioner to produce the vehicles bearing Registration No. TN-65-L 8253, Chevrolet Tavera Car, which is involved in Crime No.258 of 2026.
According to the learned counsel appearing for the petitioner, an FIR has been registered in Crime No.258 of 2026 for the alleged offences under Sections 281, 125, 292 and 285 of BNS, wherein it is alleged that some of the villagers have used the petitioner's car to participate in the Veeran Alagumuthu Kone Guru Pooja Festival.
According to the learned counsel appearing for the petitioner, in case, if the vehicle is produced and kept in the custody of the police authorities, vehicle would get damaged and therefore, now the petitioner wants to quash his summons and seeks permission of the Court to retain the custody of the vehicle.
Per contra, the learned Government Advocate(Crl.Side) appearing for the respondent police submitted that the vehicle should be produced as and when required by the competent Court and therefore, in such circumstances, the petitioner cannot be permitted to retain the interim custody of the vehicle.
The petitioner has filed an affidavit dated 04.08.2026. Paragraph Nos.3 and 4 are extracted as follows: -
“3.I submit that on 11.07.2026, my vehicle bearing Registration No. TN-65-L 8253, Chevrolet Tavera Car, was present at Kattalangulan for participating in the 316th Guru Pooja Festival of Freedom Fighter Veeran Alagumuthu Kone. I have never disputed the said fact and I admit that my vehicle went to Kattalangulam for participating in the Veeran Alagumuthu Kone Jayanthi after obtaining proper pass from the Deputy Superintendent of Police.
4.I further undertake that I will produce the vehicle bearing Registration No.TN-65-L 8253, Chevrolet Tavera Car, as and when required by the competent Court. Whenever the Court requires production of the said vehicle, I undertake to produce the same before the Court without fail.”
In such view of the matter, this Court is inclined to pass the following orders:-
The petitioner shall produce the concerned vehicle before the respondent police on 15.09.2026;
the petitioner shall also hand over the xerox copy of the RC Book. After taking photographs, the petitioner shall be permitted to take back the vehicle on the same day; and
The petitioner, as per his undertaking shall produce the vehicle before the concerned court without fail as and when called for by the competent Court.
With the above said observation, this Criminal Original Petition is disposed of. Consequently connected Miscellaneous Petition is closed.
