Judgment

On 24.07.2012, one Krishnappa S/o. Channarayappa gave a complaint to the jurisdictional police against the petitioners and the same came to be registered in Crime No. 238/2012 for the offences punishable u/s 341, 324, 307, 504 r/w 34 of IPC. Petitioners also gave a complaint against the complainant Krishnappa and the same came to be registered in Crime No. 237/2012 for the offences punishable u/s 324, 504, 506 r/w Sec 34 of IPC. Thus, there is complaint and counter complaint. The medical certificate of complainant dated 24.07.2012 specifies that he had sustained two simple injuries. It is also seen from the record that 2nd petitioner also sustained injuries and he is hospitalized.
Having regard to the nature of offences, case and counter case and the nature of injuries, I am of the considered opinion that the petitioners are to be enlarged on bail. For the reasons stated above, the following:
ORDER
The petition is hereby allowed. The petitioners are hereby released on bail on the following conditions.
i) The petitioners shall execute a personal bond for a sum of Rs. 50,000/- each (Rupees Fifty Thousand only) and a solvent surety for the likesum to the satisfaction of the trial Court.
ii) On all hearing dates, the petitioners shall be present before the trial Court.
iii) The petitioners shall not in any manner tamper with the prosecution witnesses.
Violation of any of the conditions above will result in cancellation of bail order. Ordered accordingly.
