Judgment
ALOK JAIN, J. (Oral)
The present petition has been filed seeking regular bail to the petitioner in case FIR No.46 dated 08.05.2026, under Sections 61(2), 140(3), 308(2), 308(7), 62, 108 and 351(2) of the BNS, 2023 [corresponding Sections 120-B, 365, 384, 388, 511, 306 and 506 of IPC], registered at Police Station City Kurali, District SAS Nagar, Punjab (Annexure P-1).
The contents of the FIR read as under:-
“Copy statement Inderpreet Singh "Statement of @ Pita, son of Paramjit Singh, resident of village Sahora, police station Sadar, District Kharar, aged about 28 years, mobile number 8194989907, states that I am a resident of the above said address and I am doing the work of Dairy. I have been engaged in the business of supplying milk from my home and a dairy to households across Kharar city for woman named Jyoti, the past 3-4 years. I am still unmarried. For about a year, contact with a who was a of lived in at Bhagomajra. resident a Ropar and rented house Her mobile number is 7696798265, we came to know each other. On date 30-04-2026, she introduced with me with one Sonia who lived in Zirakpur. Her mobile phone number is 8872805430. On 02.05.2026, Jyoti called me to come near Aman Resort at village Padiala. From where she took me to Kharar in car. Where I and Jyoti went a Flat No. 143, a to Platinum Homes Zirakpur in cab sent by Sonia. Where Sonia was alone in the flat. Then they took me in their arms and served me drink alcohol, then Jyoti went to another room and I and Sonia separate room. Where we both had just opened our clothes to went to a have sexual intercourse with mutual consent, whereupon two persons entered in the flat, one of which was claiming himself Sonia's husband and as soon as they came, they started beating me and forcibly took out my mobile phone Samsung Fold and Rs.12,000/- from my pocket and also clicked my nude photos. Then Jyoti told me that I have given them 3 lakh rupees. They will not put my name in the complaint, you should also give them 7 lakh rupees so that they do not file a complaint against you in the police station. Then a Sardar man along with a woman also came in the flat who claims himself to be a police officials whose name he later came to know as Lakhvir Singh son of Janta Singh resident of village Gharangwa, police station Sardulgarh, resident of Mansa, presently Rehmat Homes Dhakoli, Zirakpur and Ramandeep Kaur wife of Jagjeet Singh, resident of Flat No. 312, Block-C, 3rd Floor, Green View Heights, Zirakpur and all started raising demand of Rs.10,00,000/-from me. On dated 04.05.2026 I took sometime for arranging the payment to be given to them. For many days now Lakhvir Singh from his phone no. 6996791665, Ramandeep Kaur from her mobile phone 9915048332 and one more person who name as MS Chauhan (Advocate) from phone no. 9914361448 started threatening me while raising Rs.10,00,000/-. Due demand of this problem, a I to was under severe stress because of the threatening calls and, on 06.05.2026, I consumed poisonous substance in front of the Committee Office at Kurali in an attempt to end my life, but due to good luck I was saved. Jyoti resident of Ropar, Sonia resident of Zirakpur, Lakhvir Singh son of Janta Singh resident of village Gharangwa, police station Sardulgarh, Mansa, now resident of Rehmat Homes Dhakoli, Zirakpur, Ramandeep Kaur wife of 3rd Jagjit Singh resident of Flat No. 312 Block-C, floor Green View Heights Zirakpur and MS Chohan with phone number 9914361448 who is calling himself a lawyer and an unknown person wearing a cap, an unknown person who is calling himself Sonia's husband and an unknown person who came to the flat with him who have snatched my mobile and Rs.12 thousand from me and they were in collusion with each other. Those persons who trapped me well-planned conspiracy in a also demanded Rs.10 lakh from me by using force and intimidation. Please take appropriate legal action against them. Learned counsel for the petitioner submits that the only allegation against the petitioner is that the petitioner impersonated himself to be a Police Officer and demanded a sum of Rs.10,00,000/- along with co-accused Ramandeep Kaur and failing which they would publish the objectionable photographs of the complainant, however, the said photographs have never seen the light of the day.
Notice of motion.
Mr. Japjot Singh, AAG, Punjab, accepts notice on behalf of the respondent-State and has opposed the present petition while filing the custody certificate, which is taken on record. However, learned State counsel could not deny that the petitioner has already undergone 03 months and 12 days of actual custody and there is no other case against the petitioner.
Ms. Priyanka, Advocate, for the complainant in connected matter i.e. CRM-M-38038-2026 arising out of the same FIR, has maintained that the objectionable photographs are there and the complainant shall produce the same at the time of prosecution evidence.
Heard the learned counsel for the parties.
Considering the fact that the petitioner has clean antecedents and the challan has already been presented and more so, there was no exchange of money between the complainant and the petitioner coupled with the fact that the petitioner is in custody since 12.05.2026 and the trial is likely to take time, no useful purpose would be served by keeping the petitioner in custody, hence, the petitioner is entitled to the grant of concession of regular bail.
Without commenting upon the merits, the present petition is allowed and the petitioner is ordered to be released on bail, if not required in any other case, subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/Duty Magistrate concerned. He shall, however, be released on the following conditions:
❖ The petitioner shall declare his ordinary place of residence and the mobile number used by him.
❖ He will not switch off his mobile and in case of any technical glitch, he has to give an alternate number, which will be available in his absence.
❖ He will mark his presence before the SHO concerned, after every 15 days and in case the SHO refuses to mark his presence, he is permitted to make an application before the Illaqa Magistrate, concerned.
❖ He will not leave the country without the prior permission of the Court, for which he will submit the copy of his passport also. However, in case, the petitioner does not possess a valid passport, then he shall file an undertaking to the said effect before being released.
The petitioner shall abide by the terms and conditions as imposed in addition to Section 483 of BNSS, 2023.
However, nothing stated above shall be construed as a final expression of opinion on the merits of the case and this order shall not be considered as parity qua any other co-accused in any manner whatsoever.
It is made clear that the act and conduct of the complainant shall be thoroughly monitored all through the trial and in case, the complainant tries to evade from the process of law or turns hostile in the proceedings, the State shall take appropriate steps to proceed against the complainant.
It is further made clear that, in case, the petitioner is found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
