Judgment
Rajesh Bindal, J.—Challenge in the present petition is to the order dated 11.05.2001 passed by the learned court below in the execution proceedings whereby, the appeal filed by Zile Singh-respondent No.1 was partly allowed and the matter was remanded back.
No one has appeared for the petitioner.
The status of the execution proceedings before the trial court was called for. Copy of the order passed by the trial court on 15.02.2002 has been received which reads as under:
Ld. Counsel for the DH has made a statement that execution is fully satisfied and he does not want to pursue with the same. Keeping in view the statement made the present execution is dismissed as satisfied. File be consigned to record room after due compliance.
A perusal of the aforesaid order shows that the execution was disposed of as fully satisfied and the file was consigned to the record room.
In view of the aforesaid facts, apparently nothing survives in the present petition, however, as learned counsel for the petitioner is not available, the present petition is dismissed for non-prosecution.
