This is the first bail application filed by applicant under Section 439 of Code of Criminal Procedure for grant of regular bail relating to FIR No.200/2024, registered at Police Station-Timarni District Harda (M.P.) for the offence punishable under Sections 34(2) of MP Excise Act.

Learned counsel appearing for the applicant submitted that applicant is in jail since 08.04.2024. There is no direct evidence on record which shows involvement of applicant in commission of offence. He will cooperate in trial of the case. In these circumstances, applicant may be released on bail.

Learned Government Advocate appearing for the State opposed the application for grant of bail. It is submitted that applicant is having criminal antecedents under the Excise Act.

Heard the learned counsel for the parties.

Considering the fact that applicant is being involved in committing offences under the Excise Act, bail application filed by the applicant is dismissed.

Applicant is at liberty to file a repeat bail application after examination of independent seizure witnesses.
