This petition has been filed under Article 226/227 of the Constitution of India for issuance of directions to respondents No.2 and 3 to protect the life and liberty of the petitioners at the hands of respondents No.4 to 13 and not to harass and implicate the petitioners in any false criminal case and also directing the official respondents to decide the representation dated 10.08.2026 (Annexure P-3) of the petitioners.

On 14.08.2026, the following order was passed:-

“This petition has been filed under Article 226/227 of the Constitution of India for issuance of directions to respondents No.2 and 3 to protect the life and liberty of the petitioners at the hands of respondents No.4 to 13 and not to harass and implicate the petitioners in any false criminal case and also directing the official respondents to decide the representation dated 10.08.2026 (Annexure P-3) of the petitioners.

Dr. Mohammad Arshad, Advocate and Mohd. Aadil Hussain, Advocate, have put in appearance on behalf of respondent No.7-complainant. Learned counsel points out that petitioner No.1 is the real sister of respondent No.13 and the said respondent is the wife of petitioner No.2. He submits that the matter will have serious implications and, therefore, the same be referred to the Mediation and Conciliation Centre of this Court.

Learned counsel for the petitioners is agreeable to the same.

In view of the above, the matter is referred to the Mediation and Conciliation Centre of this Court.

Parties are directed to appear in the Mediation and Conciliation Centre of this Court on 20.08.2026.”

As per the report received from the Mediation and Conciliation Centre of this Court, the matter remained unsettled.

Learned counsel for the petitioners contends that the petitioners are in a live-in-relationship. The private respondents are not accepting the said relationship and are extending threats to them. The copies of ‘Aadhaar’ cards (Annexures P-1 and P-2) of petitioners No.1 and 2 have been placed on record.

Without commenting upon the legality of the relationship, and further keeping in view the law laid down by a Division Bench in Yash Pal and another Versus State of Haryana and others (CRWP No.4660 of 2021, decided on 09.09.2024), the present petition is disposed of with a direction to respondent No.2 to consider the representation dated 10.08.2026 (Annexure P-3) and take requisite action, if so warranted, as per the facts and circumstances of the matter in accordance with law.
