Lawyers are not physically appearing in the Court in view of the unprecedented situation being faced by the country due to pandemic of novel corona
virus (COVID-19).
The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R.
No.515/2021, Police Station Subhashnagar, District Bhilwara for the offences under Sections 376, 286 & 452 of the I.P.C.
Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submits that the petitioner & Mst.â€L†are living together for last four years and the dispute arose on a trivial issue
resulting into lodging of the present F.I.R. He further submits that on earlier occasion also, one F.I.R. was registered by Mst.â€L†against the
present petitioner but thereafter, they have again started living together.
Learned counsel for the petitioner after arguing the matter for quite some time felt advised not to press the present bail application filed under Section
439 Cr.P.C. on behalf of the petitioner at this stage, however, seeks liberty to file fresh bail application after filing of the charge-sheet.
Dismissed accordingly with liberty as prayed for.
