1.

THIS complaint is placed for admission hearing. The claim in the complaint has been made for a sum of Rs. 22,69,490/- in respect of shares alleging deficiency which value around Rs. 5,00,000/-.

2.

AS per recent judgment of Supreme Court in the case of Charan Singh v. Healing Touch Hospital & Ors., reported in the Supreme Court Cases III (2000) CPJ 1 (SC)=VI (2000) SLT 867=(2000) 7 SCC 688, the party making claim before the Consumer Forum has to furnish particulars and is to be rational in claiming compensation. Just for alleging deficiency in respect of shares for Rs. 5,00,000/- claiming compensation of Rs. 10,00,000/- and rest of the amount towards interest cannot be said to be rational and reasonable as such. We are, therefore, ordering return of this complaint, directing the complainant to be rational and realistic in structuring his claim in this complaint and then pursue remedy before appropriate Forum. ORDER 1. Complaint to be returned to the complainant. 2. As far as this Commission is concerned, complaint to be treated as disposed of. 3. Office to furnish copies of the order to the parties.

Four weeks'' time is granted to the complainant to take steps as above. Complaint disposed of.
