Judgment
Heard Shri H.S. Paonam, learned Sr. Counsel appearing for the petitioner.
According to the petitioner, she is the Programme Officer (ICDS) who is the senior most in the section of ICDS and vide order dated 18-12-2019, the
petitioner was allowed to hold the charge of Deputy Director (ICDS). As per the recruitment rules for the post of the Deputy Director (ICDS), only
the Programme Officer (ICDS) or its equivalent is eligible for appointment as the Deputy Director (ICDS).
The grievance of the petitioner is that the order dated 22-4-2021, impugned herein, has been issued by the Deputy Secretary (Social Welfare),
Government of Manipur appointing Shri A. Kameshwar Singh, District Social Welfare Officer, Thoubal as in-charge Deputy Director (ICDS) which is
not permissible in law for two reasons â€" (i) the petitioner who was holding the Deputy Director as in-charge has been replaced by another person
appointed on in-charge and (ii) Shri A. Kameshwar Singh is not from the ICDS section.
In view of the above, let notice be issued to the respondents returnable on 10-6-2021.
Ms. Tejpriya, learned counsel accepts notice on behalf of respondent Nos. 1 & 2 and hence, no formal notice is called for. As regards respondent No.
3, steps be taken by the counsel appearing for the petitioner for service of notice upon him by speed post.
By way of interim measure, it is directed that the order dated 22-4-2021 appointing respondent No. 3 as the Deputy Director (ICDS) shall remain
suspended till the next date.
Copies of this order shall be sent to the counsel appearing for the parties through their WhatsApp/e-mail.
