On having the Respondent counsel stated that service has not affected against the Respondent, when we verified the e- filing, we have noticed in the index, that service proof is on page 588, but the volume consisting of page 588 is not seen in the e-filing. Only volume-1 is there consisting of pages 199.
We are at loss to know as to whether or not service has been affected by the applicant.
At last, on applicant counsel being present, upon verification, we have noticed that copy was not served upon the Respondent before filing this company petition, therefore, at request of the applicant, this company petition is hereby dismissed as withdrawn with liberty to file this company petition after service is properly effected upon the respondents.
Accordingly, this company petition is dismissed as withdrawn.
