Judgment
Heard Mr. H. Debbarma, learned counsel appearing for the appellant and Mr. T. D. Majumder, learned senior counsel assisted by Mr. T. Halam, learned counsel appearing for the respondents.
A certain development has taken place. The respondent namely Mr. Sumen Debbarma has tendered an unconditional apology to the appellant. Not only that, by means of a declaration affirmed by the affidavit, the respondent has recorded his remorse as well as apology. It has been reported to us and recorded in the said affidavit, at para-2, that the respondent has physically expressed his apology to the appellant.
In view of the said development, the appellant through her counsel Mr. H. Debbarma, learned counsel has stated before us that she will not prosecute the appeal and the appeal may be closed. Thus, she has withdrawn the challenge.
The appellant is present in person before this court and she has reiterated that she does not like to continue with the appeal on the face of the apology tendered by the respondent. Hence, the appeal stands dismissed as not pressed.
Draw the decree accordingly.
