Judgment
The Court proceedings have been conducted through Video-Conference due to COVID-19 pandemic.
This is an application under Section 482 of the Code of Criminal Procedure, 1973 seeking quashment of the FIR in Simla Police Station Case
No.22/2021 under Sections 420/468/469/471/482/483/486 of the Indian Penal Code.
I have heard Mr. G.N. Sahewalla, learned senior counsel assisted by Ms. S. Todi, learned counsel for the petitioner. Also heard Mr. B.B. Gogoi,
learned Additional Public Prosecutor, Assam appearing for the State Respondent.
Since the State Respondent has entered appearance through Mr. Gogoi, learned Additional Public Prosecutor, and he has received copies of the
petition and the annexures thereto, no formal notice need be served on Respondent No.1.
Issue notice upon Respondent No.2 under Registered Post with A/D as well as under ordinary process.
The matter be listed immediately after service of notice on 20.07.2021.
Heard on interim prayer.
On consideration of the materials available before this Court as of now, further proceedings in the FIR of the aforesaid Simla Police Station Case
No.22/2021 shall remain stayed till the date fixed.
