The learned counsel for the petitioner has filed a memo dated 09.02.2023, which reads as follows:
"That the Petitioner filed the above RPFC against the Order passed by the Prl. Judge Family court, Raichur on IA No. 3 dated: 31.12.2022. The office of this Hon'ble Court raised the objection regarding maintainability, stating that RPFC is not maintainable U/s 19(1) of the Family Court Act on interlocutory orders. Therefore, the petitioner prayed that, this Hon'ble Court kindly permit the petitioner to Convert this petition into writ petition, in the interest oft justice and equity."
In view of the memo, the petitioner is permitted to convert the present revision petition into a writ petition.
For statistical purposes, this petition shall be treated as disposed.
The learned counsel for the petitioner to comply with the necessary office objections pursuant to the conversion within two days from today.
The learned counsel for the petitioner pleads urgency.
In view of the same, Registry to take suitable orders and post before the appropriate Bench on 13.02.2023.
