This matter is taken up by video conferencing mode.
Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 439 of Cr.P.C. for grant of bail to the petitioner in connection with Orkel P.S. Case No. 125 of 2020
corresponding to T.R. No. 70 of 2020 pending in the Court of learned Sessions Judge â€"cum- Special Judge, Malkangiri for alleged commission of
offences under sections 20(b)(ii)(C)/27-A of the N.D.P.S. Act.
The prayer for bail of the petitioner has been rejected by the learned Sessions Judge â€"cum- Special Judge, Malkangiri by order dated 07.01.2021.
The quantity of ganja stated to have been seized in this case is 660 Kgs and the petitioner’s involvement is that he procured the Ganja and was
instantly supplying to the State of Chhatisgarh which were seized on the way by the Sub-Inspector of Police of Orkel police station and the co-
accused persons also implicated the petitioner regarding his involvement in the alleged crime and in view of the bar under section 37 of the N.D.P.S.
Act, I am not inclined to release the petitioner on bail.
Accordingly, the BLAPL stands dismissed.
