Considered I.A.No.10009/2020, which is an application for suspension of sentence on behalf of appellant-Kunwar Singh who has been convicted vide judgment dated 25.8.2020 for offence under section 136 of the Electricity Act, 2003 and sentenced to undergo R.I. for 1 year and fine of Rs.10,000/- with default stipulations.

Learned counsel for the appellant/applicant submits that the sentence awarded to the applicant is only one year. It is further submitted that on account of prevailing situation of Covid-19 pandemic the disposal of this appeal would take considerable time and, therefore, the substantive jail sentence of the appellant be suspended and he be granted bail.

Considering the facts and circumstances of the case and quantum of sentence awarded to the appellant, without commenting on the merits of the case, I.A.No.10009/2020 is allowed. It is directed that on furnishing personal bond of Rs.25,000/- [Rupees Twenty Five Thousand only] with one solvent surety in the like amount to the satisfaction of the trial Court, the remaining part of the substantive jail sentence imposed upon appellant-Kunwar Singh is suspended during pendency of this appeal and he be released on bail. The appellant shall appear before the trial Court on 21.12.2020 and on subsequent dates as may be fixed in this regard during the pendency of this appeal.

I.A.No.10009/2020 stands disposed of.
