S.K. Gangele, J.—Heard. The petitioner has filed this petition against the order dt. 9.4.2012 (Annexure P/1) passed by the Collector. By the aforesaid order, the Collector rejected the application of the petitioner.

Earlier the petitioner filed a petition before this court, it was registered as W.P. No. 7389/2011. The court vide order dt. 23.11.2011 directed the Collector to decide the representation. The Collector has observed that the land area 2.978 hectare of survey No. 2277 situate at village Gahora, Tehsil Isagarh is a government land and out of the aforesaid land, 1.000 hectare has been allotted for the purpose of construction of High School building. The petitioner has no ownership and right over the aforesaid land. The petitioner has not filed any document to substantiate the claim of the petitioner that the petitioner has right of ownership of the land. The petitioner only filed a copy of the order dt. 20.8.2011, by which the Gram Nyalaya granted injunction in favour of the petitioner. In the aforesaid order, it has been observed that the petitioner is in possession over the land. The aforesaid finding has been recorded by the court on the basis of submission made by the petitioner but the petitioner did not file any documentary proof to substantiate the claim of possession for long time.

Looking to the aforesaid facts of the case, in my opinion, there is no merit in this petition. The land has already been allotted for the purpose of construction of High School building. Hence, I do not find any merit in this petition. It is hereby dismissed. No order as to costs.
