R.K. Pattanaik, J

1.Heard learned counsel for the respective parties.

2.

Instant writ petition is filed by the petitioner for a direction to the opposite parties and in particular, opposite party No.5 not to evict him and other members of the Bar Association from the room provided in the Collectorate on the ground stated therein.

3.

The grievance of the petitioner and members of the Bar Association is that a room has been provided by the Collectorate which is, however, a temporary accommodation, which they should be allowed to occupy permanently.

4.

In course of hearing, learned counsel for the petitioner submits that no grievance petition has been filed claiming such permanent use of the room allotted to the petitioner and other members of the Bar Association at the Collectorate, which is presently in occupation by them.

5.

Mr. Rout, learned AGA for the State submits that there has been no decision by opposite party No.5 as yet though earlier a negotiation was expected.

6.

Without keeping the matter pending for long, the Court is of the considered view that the petitioner and other members of the Bar Association should be provided an opportunity to submit a grievance petition addressed to opposite party No.5 with a request for the latter to allow them to use and utilize the temporary accommodation provided at the Collectorate permanently.

7.

Accordingly, it is ordered.

8.

In the result, the writ petition stands disposed of with a direction to the petitioner and other members of the Bar Association to submit a representation addressed to opposite party No.5 with a request to allot the room in occupation at the Collectorate permanently and in the event, such grievance is received from them, the said authority shall consider it and take a final decision on the same as soon as possible preferably within a period of eight weeks from the date of receipt of a copy of this order.

9.

Urgent copy of this order be issued as per rule.

10.

A copy of the order be handed over to Mr. Rout, learned AGA for State for its onward intimation to opposite party No.5 for early compliance.
