The present is a restoration application against the order dated 25.07.2017 whereby the appeal was dismissed in non-compliance of the per emptory order dated 25.03.2017 passed by the Court. Vide order dated 25.03.2017, three weeks’ time was granted to remove the defects as pointed out by the office which were not removed within the stipulated period.
The present restoration application is also reported to be barred by 119 days and four other defects were pointed out by the office way back in the year 2017. The said defects have not been removed despite time being granted by Registrar (Admn.) on 27.11.2018 and further by the Court on 26.07.2023.
On 26.07.2023, last opportunity of two weeks’ was granted and it was observed by the Court that if the defects are not removed within the stipulated period, the restoration application would be listed for dismissal.
As per the office report, the defects have not been removed till date.
In view of the same, the present restoration application is dismissed in non-compliance and non-prosecution.
