Both these petitions seek of quashing of respective FIRs and being connected and cross-cases, both these petitions have been taken up together.
Alleged incident is of 31.10.2023.
Both the parties are neighbours, residing in same building, albeit, occupying different floors.
Trigger point of the quarrel was some seepage and both the sides entered into confrontation and scuffle and some of the female members were, allegedly, inappropriately touched and indecent words were also exchanged.
On the basis of complaint made by petitioners in CRL.M.C. 327/2026, FIR No. 734/2023 dated 01.11.2023 under Sections 354/354(B)/509/323/34 IPC was registered with PS Patel Nagar. Since there was no requisite action on the complaint given by other side, respondents in CRL.M.C. 343/2026 were compelled to file application under Section 156 (3) Cr.P.C. which resulted in registration of FIR No. 239/2024 dated 23.05.2024 under Sections 354/354(B)/509/323/34 IPC PS Patel Nagar.
Charge-sheets in both the matters have already been filed.
Both the parties have, now, resolved their disputes amicably and have entered into Memorandum of Understanding (MoU) on 01.10.2025 and the copy of MoU, signed by all concerned, has been placed on records in both the aforesaid matters.
There were other cases also between the parties, which have been described in MoU. During course of arguments, learned counsel for respective parties informed that all such other cases have also been withdrawn.
Respondent nos. 2 & 3 in both the matters are present. They have been duly identified by their respective counsel and IO.
In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest.
Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIRs.
Consequently, to secure the ends of justice, FIR No. 734/2023 dated 01.11.2023 under Sections 354/354(B)/509/323/34 IPC PS Patel Nagar and FIR No. 239/2024 dated 23.05.2024 under Sections 354/354(B)/509/323/34 IPC PS Patel Nagar, along with all consequential proceedings emanating therefrom, are hereby, quashed.
The petitions, along with the pending application, stand disposed of in aforesaid terms.
