Heard learned counsel for the parties.
This writ petition has been filed by Kumaun Lok Kalakar Mahasanghatan, which is an association of Cultural Groups, and which is registered under the Societies Registration Act. According to the petitioner, they have made representations for extending the validity period of their registration with the Information and Public Relations Department, from three years to five years. One such representation dated 26.02.2021 is on record at page no.30 of the writ petition.
By means of this writ petition, petitioner has sought the following reliefs:-
(i) Issue a writ, order or direction in the nature of certiorari, quashing the impugned advertisement dated 18.02.2020 issued by respondent (Annexure No.33 to this writ petition).
(ii) Issue a writ, order or direction in the nature of mandamus, commanding/directing the respondent to extend three years contract of the societies run under the control and supervision of the petitioner.
According to the petitioner, respondent no.1 has issued an advertisement on 18.02.2021, inviting applications for registration of cultural groups. Learned counsel for the petitioner submits that during 2020, no work was assigned to the petitioner in view of pandemic caused by COVID-19, therefore, respondent no.1 be directed to extend the validity period of petitioner's registration for one more year.
What would be the validity period of the registration, can be decided only by the State Government. Therefore, the relief as prayed in the writ petition cannot be granted under Article 226 of the Constitution of India. However, having regard to the facts and circumstances of the case, the writ petition is disposed of with the direction to the respondent no.1 to take a decision on petitioner's representation dated 26.02.2021, as early as possible, preferably within a period of six weeks from the date of production of a certified copy of this order.
Let certified copy of this order be issued to the parties today itself on payment of usual charges.
