Heard.

Learned counsel for the appellant submits that the admission in the BAMS (Bachelor of Ayurvedic Medicine and Surgery) Course is to be given on

the basis of merit/rank secured in NEET National Eligibiliy-cum -Entrance Test) Examination. The respondent-5 gave admission to the less

meritorious candidate than the petitioner.

Shri Sudeep Agrawal, learned State counsel submits that the petitioner has not arrayed the candidates as party respondents, who are stated to be less

meritorious than that of petitioner, who are necessary party. The petition is not maintainable for want of necessary party. He further submits that as

per Annexure P2, candidates were requested to make applications for admission by wpc 2224 of 2021 06.05.2021 till 2 pm. The merit list is prepared

on the basis of applications received till the cut off date and time. He submits that a short time may be granted to submit the reply to the grounds

raised in Writ Petition.

Issue notice to the respondents.

Shri Sudeep Agrawal, learned Dy AG accepts notice on behalf of respondents- 1, 2 and 3.

Shri Ramakant Mishra, learned ASG accepts notice on behalf of respondent-4.

Notice to respondent-5 by Speed Post.

Petitioner is at liberty to serve notice to respondent- 5 through Dasti.

PF to be paid within three days.

Shri P. Acharya, learned counsel for the petitioner submits that the petitioner could not make the less meritorious candidate as party respondent,

because she was not having their details. The respondent/ State be directed to supply the necessary information.

It is directed that, if the petitioner approaches respondent- 2 or 5 for getting the details of persons who are stated to be less wpc 2224 of 2021

meritorious than the petitioner, concerned respondent shall be obliged to give such information as sought for by the petitioner within a week from the

date of receipt of application..

List this case on 7th June, 2021.
