S. Abdul Nazeer, J.—I have heard the learned Counsel for the parties.

The point in issue in this writ petition is covered by a decision of this Court in W.P. Nos. 22235 to 22256/2010 disposed of on 15.9.2010 (between Anil Kumar K.C. and Ors. v. The Vice Chancellor and Ors.).

In the light of the said order, the impugned notice at Annexure ''J'' dated 8.1.2010 is treated as a show cause notice by the 1st Respondent (University of Mysore) calling upon the Petitioner as to why the degree certificate issued to her earlier should not be withdrawn. The Petitioner is granted three months from today to file her objections to the show cause notice. The Enquiry Committee of the University of Mysore is directed to hold an enquiry and submit its recommendations to the Registrar of the University. Thereafter, the competent authority of the 1st Respondent-University is directed to pass appropriate order thereon in accordance with law. It is needless to opportunity of being heard to the Petitioner before submission of the report.

Pursuant to the interim order passed by this Court, the Petitioner was permitted to appear for the I and II semester MBA Examinations conducted by Bangalore University (the 2nd Respondent). However, results have not been declared by the 2nd Respondent. The 2nd Respondent is directed to permit the Petitioner to appear for the ensuing III semester MBA Examination. The 2nd Respondent shall not declare the result of the examination token by her even in respect of III semester MBA course. Declaration of results of the examination taken by the Petitioner pursuant to the interim orders passed in this case is subject to the decision, which may be taken by the University of Mysore.

Writ petition stands disposed of accordingly. No costs.

Since the writ petition is disposed of as above, Misc. W. No. 11821/2010 does not survive for consideration and is accordingly dismissed.
