Judgment

The case had been registered against respondents No. 1 to 3 with respect to offences punishable under sections 302/304B/120B/193/34, I.P.C. Petitioner Kulwant Singh is the father of the deceased. It is alleged that on two occasions when the petitioner had gone to Amritsar to persue the Sessions case referred to above, he was assaulted on one occasion and in fact a complaint was filed by one Swaran Singh. He apprehends such danger and requests for transfer of the case from District Amritsar.
No opinion with respect to the instance at Amritsar need be expressed, but, keeping in view the nature of facts that has come to light, it would be appropriate that this case be transferred from District Amritsar.
It is directed that Sessions case referred to above recorded in FIR No. 147 dated 2.12.1992, P.S.B. Division, Amritsar be transferred from the Court of Sh. Nirmal Singh, Addl. Sessions Judge, Amritsar to Sessions Court at Jalandhar. Parties will appear before the learned Sessions Judge, Jalandhar on 2.5.1995. Learned Sessions Judge may try the case himself or may assign the same to a Court of competent jurisdiction.
JUDGMENT accordingly.
