Judgment
This writ petition has been filed by the petitioner for claiming a sum of Rs.15,287/- from the respondents on the ground that the same is due to him towards medical reimbursement.
Evidently, it is not in dispute that the entire matter was looked into by the Insurance Ombudsman, who vide its detailed order dated 17.3.2016 (Annexure P-10) rejected the claim of the petitioner by according following reasons: "After hearing the parties and counsel of the Complainant and perusal of record exhibited it is clearly established that the record maintained by J.N.Shori Hospital, Pinjore cannotbe relied as there is difference in the month of admission in the hospital. As per certificate issued to Shri Kulwant Kumar, he has been shown to have been admitted from 14.9.2006 to 17.9.2006 whereas as per hospital record the dates are 14.10.2006 to 17.10.2006. Dr. Shori appears to have attempted to correct it by issuing an undated certificate (Exhibit C-X). The doctor admitted that the Exhibit (I-I) (bed head ticket dated 14.10.2006 to 17.10.2006) was issued due to clerical mistake by their employee but she admitted her signatures on it. Further the Complainant was not admitted in the hospital on the dates and this fact was confirmed by the Complainant himself during his cross-examination. He also confirmed that he was not on leave from official duties on these dates. This is a document which independently establishes that it was wrongly issued. This is also enough proof that the documents issued by the hospital cannot be relied upon. Moreover, the vital parameters are recorded for the period from 14.9.2006 to 20.9.2006 whereas as per doctor''s own admission that the patient was stated to be hospitalized for the period from 14.9.2006 to 17.9.2006. The three prescription slips produced by the complainant of J.N. Shori Hospital dated 14.9.2006; 17.9.2006 and 22.9.2006 (Exhibits C-III, C-IV and C-V respectively) are bearing the address as J.N. Shori Hospital, Nalgarh Road, Panchkula (Haryana) where J.N. Shori Hospital is situated at Pinjore. This, itself proves that these documents (Exhibit C-III, C-IV and C-V) could not be relied upon."
The claim of medical reimbursement of Rs.15,287/- has been set up by the petitioner on the ground that he was hospitalized in J.N. Shori Hospital Pinjore from 14.9.2006 to 17.9.2006. Now, even if it is presumed that the petitioner remained admitted in this hospital w.e.f. 14.9.2006 to 17.9.2006 as claimed by the petitioner then how come the documents of the hospital placed on record show the pulse rate, blood pressure and temperature of the petitioner w.e.f. 14.10.2006 to 20.10.2006 when admittedly even as per his case, he was not admitted w.e.f. 18.10.2006 to 20.10.2006. Not only this, even the treatment chart for the aforesaid period has been produced on record which clearly establishes beyond doubt that the petitioner in connivance with the hospital in question has been instrumental in preparing fake and fabricated bills and on the basis thereof claiming medical reimbursement.
Even though the learned counsel for the petitioner would claim that it is only on account of the mistake committed by the hospital wherein instead of showing the month as September, they have shown the month of October in the treatment chart for which, he should not be made to suffer. However, I find this contention to be without merit as the respondents have placed on record plethora of documents wherein alleged dates of treatment of the petitioner have been shown w.e.f. 14.10.2006 to 20.10.2006, which have subsequently been interpolated and the treatment chart of the petitioner is shown to have been prepared in September 2006.
Normally this Court would have dismissed this petition by imposing heavy cost, but taking into consideration that the petitioner is only a low-paid employee, the court refrains from doing so. The petitioner is well advised not to indulge in such adventurous litigation in future.
In view of the aforesaid discussion, I find no merit in the writ petition and the same is accordingly dismissed leaving the parties to bear their own costs. Pending application(s), if any, also stands disposed of.
