Judgment
The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.486/2020
registered at Police Station Beawar City District Ajmer for the offence(s) under Section(s) 306 of IPC.
It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Drawing attention of this Court
towards material on record and statement of prosecution witnesses under Section 161 CrPC, learned counsel for the petitioner contended that the
dispute arose during construction of the kitchen in joint Hindu property and even the basic ingredients necessary to constitute the offence under
Section 306 are lacking in the present case. He submitted that the petitioner has also lodged an FIR No.484/2020 with the Police Station Beawar City
District Ajmer which reflects that the complainant party was aggressor wherein she has also received grievous injury on vital part of her body. He
submitted that the petitioner is in custody since 11.08.2020, charge-sheet has already been filed, trial of the case will take time and prays for her
release on bail.
Learned Public Prosecutor has opposed the bail application.
Taking into consideration the submissions advanced by learned counsel for the petitioner, nature of allegation against her, her length of custody and
filing of the charge-sheet; but, without expressing any opinion on the merits of the case, this court deems it just and proper to enlarge the petitioner on
bail.
Accordingly, the bail application is allowed and it is directed that accused-petitioner Smt. Kulvindra Kaur W/o Shri Dhirendra Singh shall be
released on bail under Section 439 Cr.P.C. in connection with afore-mentioned FIR registered at concerned Police Station, provided she furnishes a
personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only)
each to the satisfaction of the trial court with the stipulation that she shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
