Judgment
Ranjit Singh, J.—This petition has been filed for quashing of FIR No.80, dated 17.8.2004, registered under Sections 406/420 IPC, at Police Station Goraya, District Jalandhar, on the basis of compromise.
Notice was issued on 19.1.2006. It was reported that the notice issued to respondent No.2 could not be served as she was not found residing at the given address. Fresh notice was issued with direction to the petitioners to furnish the correct address. Still, the counsel did not take any action to furnish the correct address of respondent No.2. Counsel had prayed for dasti service, but still was not able to effect service on respondent No.2. The case was, accordingly, adjourned sine die on 11.7.2007. This petition has now been listed for hearing. No one appears for the petitioners.
Prayer made for quashing of FIR on the basis of compromise, which has remained pending since 2007, may not call for any adjudication on the basis of the prayer made in the petition. If the petitioners have been really interested in seeking end to this prosecution on the basis of compromise, they would have taken action to get the case listed and decided. Most likely, the case may have now been finally decided. If the case is still pending, then the parties can plead before the Court on the basis of this compromise.
The present petition is, however, dismissed.
