Kuldeep Singh vs State of Punjab

Present petition has been filed under Section 483 of the BNSS, 2023 read with Section 528 of the BNSS, 2023 seeking extension, for a further period of 30 days, of the interim bail granted to the petitioner, vide order dated 23.07.2026 passed in CRM-M-33801-2026, in case bearing FIR No.116 dated 20.08.2025, registered under Sections 109, 115(2), 3(5) of the BNS, 2023 (Sections 27/ 54/ 59 of the Arms Act, 1959 and Section 238(B) of the BNS, 2023 added later on), at Police Station Gidderbaha, District Sri Muktsar Sahib.

Learned counsel for the petitioner has submitted that, vide order dated 23.07.2026 passed by this Court in CRM-M-33801-2026, the petitioner was granted the concession of interim regular bail for a period of 30 days, taking into consideration the medical condition of his wife. It has been submitted that, upon expiry of the aforesaid period, the petitioner is required to surrender to custody on 22.08.2026. Learned counsel has urged that the wife of the petitioner is advised to report for proposed surgery tomorrow, i.e. 22.08.2026, and that the presence and assistance of the petitioner are required in view thereof. It has also been urged that the petitioner has not misused the concession of interim regular bail granted to him. Accordingly, extension of the interim bail granted vide order dated 23.07.2026 ibid has been prayed for.

On the strength of advance service of copy of petition; Mr. Adhiraj Singh Thind, AAG Punjab causes appearance and accepts notice on behalf of the respondent – State of Punjab.

I have heard learned counsel for the rival parties and have perused the paper book.

The petitioner was granted the concession of interim regular bail, vide order dated 23.07.2026 ibid for a period of 30 days. It has been urged before this Court that wife of the petitioner is to undergo surgery tomorrow, i.e., 22.08.2026.

Keeping in view the nature of the prayer as also factum that surgery upon the wife of the petitioner is likely to take place tomorrow, i.e., 22.08.2026, in the considered opinion of this Court, there is no time left out to ask the State to file written reply.

Keeping in view the entirety of the factual milieu of the case in hand; especially the factum of the petitioner not having misused the concession of interim regular bail till date; this Court deems it appropriate to grant interim bail for a further period of 10 days on his furnishing bail/surety bonds to the satisfaction of the concerned Chief Judicial Magistrate/ Duty Magistrate. The petitioner shall also abide by the conditions mentioned in the order dated 23.07.2026.

In case of breach of any of the aforesaid conditions and those which may be imposed by concerned Chief Judicial Magistrate/ Duty Magistrate or upon showing any other sufficient cause, the State/ complainant shall be at liberty to move cancellation of bail of the petitioner.

The petitioner shall cause his appearance before the concerned Chief Judicial Magistrate/ Duty Magistrate upon expiry of further 10 days period granted today. In case, he fails to do so, said Court shall take requisite steps to take him back into custody.
