Judgment
Tarlok Singh Chauhan, J
The instant petition has been filed for grant of the following reliefs:
"1. That the writ in the nature of mandamus may kindly be issued and the official respondents be directed to release the retiral benefits i.e. Gratuity and monthly pension to the petitioner.
That respondent may be directed to pay the retiral benefits to the petitioner along with interest @ 9% from due date i.e. from 31.05.2018 (the date of retirement) till actual payment."
In the reply filed by the respondents, it has been specifically stated that as regards leave encashment, an amount of Rs. 4,56, 136/- has already been paid to the petitioner vide office cheque No. 441619 dated 20.09.2018 and as regards the retirement gratuity, the same is under process by the Accounts Officer (Pension). An affidavit was filed as far back as on 02.01.2020 and the remaining retiral benefits now have been undertaken to be paid within a period of four weeks.
Accordingly, we dispose of the instant writ petition by directing the respondents to remit the retirement gratuity within a period of four weeks from today, failing which, the respondents shall liable to pay interest @ 9% per annum. Pending application, if any, also stands disposed of.
For compliance, to come up on 26.10.2020.
