Judgment
Heard Shri M. Devananda, learned counsel appearing for the petitioner.
According to the petitioner, she is a lady doctor working in the Assam Rifles and that too, as a Specialist in ENT.
The petitioner was transferred vide order dated 10-6-2019 from a hospital at Dimapur to Assam Rifles Multispecialty Hospital at Mantripukhri. Before
the completion of two and half years as prescribed in the guidelines as regards transfer and posting, the petitioner was transferred from ARMH
(Mantripukhri) to 7 AR (Kiphire) vide order dated 19-3-2021. The grievances of the petitioner are inter alia that she has been transferred without
completing her two and half years as prescribed in the guidelines and that the recommendation made in her favour in terms of the orders dated 7-12-
2011 and 3-10-2015, has not been appreciated by the higher authority while issuing transfer order.
In view of the above, let notice be issued to the respondents returnable on 12-5-2021.
Shri B.R. Sharma, learned counsel accepts notice on behalf of the respondents and hence, no formal notice is called for.
By way of interim measure, it is directed that the order dated 19-3-2021 by which the petitioner was transferred from ARMH (Mantripukhri) to 7 AR
(Kiphire) shall remain suspended till the next date and the consequential movement order alleged to have been issued on 29-4-2021 also shall remain
suspended.
Shri B.R. Sharma, learned counsel submits that since the matter being relating to transfer and posting , a short date may be given so that the matter
can be disposed of on the next date itself.
List the matter on 12-5-2021 for final disposal in the category of admission and he is permitted to file counter by 10-5-2021.
