Judgment
T.R. Ramachandran Nair, J.—The petitioner is the Manager of a High School, namely C.H.M.K.M. High School, Kavanur, Thottilangadi in Malappuram District. The requirement of the petitioner is to upgrade the school as a Higher Secondary School. Challenge is against Exhibit P9 order passed by the Government dated 20.7.2010, in which certain schools were granted Higher Secondary courses. The main contention raised by the petitioner is that Exhibit P9 does not consider the case of the petitioner and no reasons have been stated also. Exhibit P7 is the notification inviting applications from Headmasters/Managers of Government/Aided High Schools for sanctioning new Higher Secondary courses. Exhibit P8 is the application submitted by the petitioner.
The learned counsel for the petitioner submitted that the petitioner will be satisfied if a direction is given to the Government to reconsider the matter.
The learned Government Pleader submitted that decision, if any, can be taken by the Government only in terms of the policy decision to be taken for the next academic year.
It is pointed out by the learned counsel for the petitioner that by Exhibit P10 judgment, this Court disposed of another Writ Petition, W.P.(C).No.23351/10 and pursuant to the same, the Government has granted Higher Secondary courses for the school involved therein. The academic year is nearing to an end. Therefore the matter will have to be considered by the Government in the next academic year in terms of the then existing policy and appropriate decision will be taken and the result will be informed to the petitioner expeditiously, at any time such applications are considered and disposed of.
The Writ Petition is disposed of as above.
