Judgment

Vide order dated 22.12.2023, this matter is listed before the Vacation Court.
Present Mr.S.Biswajit, learned senior counsel assisted by N.Prista, learned counsel for the petitioner and Ms.I.Lenibala, learned counsel along with Ms.Thajamanbi, learned counsel for the respondent.
Vide order dated 23.5.2023, while issuing Notice, this Court framed four issues involved in the present case regarding maintainability of the proceeding before the learned CJM, Thoubal. However, the prayer of the stay was not considered on that day.
Vide order dated 4.7.2023, Ms.I.Lenibala, learned counsel for the respondent undertook not to pursue any proceeding for payment of the 10% interim amount as directed by the learned CJM, Thoubal.
On the submission made by learned counsel for the respondent, no stay order has been passed till date and the undertaking is extended from time to time.
It may not be proper for this Court to hear this matter in the Vacation Bench and dispose of on the merit of the case and hearing on the four issues framed, will take some time.
Both the learned counsel prays for listing this case on 11.01.2024.
Mr.S.Biswajit, learned senior counsel submits that the proceedings before the learned CJM Thoubal may be stayed till the next date as the stage is in examination of witness.
Ms.I.Lenibala, learned counsel for the respondent submits that the said proceeding stage is since, 2020.
Before deciding the four issues framed by this Court, if the proceedings before the learned CJM concludes, the purpose of filing the present revision petition may not survive.
Mr.S.Biswajit, learned senior counsel submits that he will make all endeavour to dispose of the revision petition as early as possible.
Recording this, list this case on 11.01.2024 before the Roster Bench. Till the next date, proceedings before the learned CJM, Thoubal in Cril (NI) Case No.21 of 2019 is stayed.
Furnish a copy of this order to learned counsel for the parties.
