Judgment

The petitioners are brothers. The 1st petitioner purchased ordinary sand from the Irrigation Department which was drudged from Chulliyar Dam. The 1st petitioner transported the sand and stacked it in the yard of the 2nd petitioner. Thereafter the petitioners approached the 1st respondent requesting dealer's license and transit pass to sell the sand stacked in the 2nd petitioner's yard. After receipt of the application, the 1st respondent issued Ext.P3 communication informing that the matter has been forwarded to the 2nd respondent for opinion and further action will be taken only after getting opinion from the 2nd respondent. The 2nd respondent issued Ext.P4 reply to the 1st respondent and directed him to take action in the subject matter in accordance with the rules. The grievance of the petitioners is that, the 1st respondent has not so far considered the application for dealer's license.
Having heard Sri. P.M. Ziraj, the learned counsel for the petitioners and Sri. Rajeev Jyothish George, the learned Government Pleader, this writ petition is disposed of with a direction to the 1st respondent to consider and dispose of the application submitted by the petitioners on the basis of Ext.P3 communication and Ext.P4 reply, in accordance with law, after hearing the petitioners, within a period of one month from the date of receipt of a copy of this judgment.
