This application has been filed by the petitioner-wife under Section 24 (1) of C.P.C. for transfer of C.P. No.169 of 2021 filed by the opp. party-husband under Section-13 of the Hindu Marriage Act in the Court of learned Judge, Family Court, Dhenkanal, to the Court of learned Judge, Family Court, Jajpur.
Mr. Mohapatra, learned counsel for the petitioner submits that on account of ill-treatment and indecent demands by opp. party to which the petitioner objected, she has been assaulted and driven out from his house on several occasions. The opp. party had filed C.P.No.67 of 2021 earlier for restitution of conjugal rights, which was ended in compromise, but the opp. party continued with the same activities and ill-treatment, for which the petitioner is residing with her parents at Dharapur in the district of Jajpur, which is more than 150 K.Ms away from Dhenkanal and as such the petitioner is apprehensive to go to attend the case in the court of learned Judge, Family Court, Dhenkanal.
Considering the above submissions, issue notice to the opp. party both in TRP (C) as well as in the I.A. by registered/speed post with A.D., requisites for which shall be filed within a week. The notice shall be made returnable within three weeks.
