This writ petition has been filed challenging Ext.P5 order through which an order of assumption in respect of 4.1 acres of land was issued under the
provisions of the Kerala Land Reforms Act, 1963. This assumption was pursuant to proceedings initiated against one 'Janu', who is stated to have
bequeathed the properties in question to the petitioners in terms of a will.
The complaint of the petitioners is that they were not heard before Ext.P5 order was passed. When the matter is taken up today, the learned
counsel for the petitioners would submit that, subsequent to filing of this writ petition, the petitioners were heard and were given opportunity of filing a
fresh option statement identifying the land to be surrendered. It is also stated that the Taluk Land Board has, thereafter, issued fresh proceedings in
the matter. Therefore, nothing survives for adjudication in the present writ petition.
It is accordingly, closed, reserving liberty to the petitioners to challenge the subsequent proceedings of the Taluk Land Board, in accordance with law,
if they are aggrieved by it.
