Judgment
M.L. Tahaliyani, J.—Heard learned Counsel Shri S.N. Kumar for the applicants and learned Counsel Shri A.S. Manohar for the non applicant. Admit. Heard finally by consent of learned Counsel for the parties.
The applicants are accused Nos. 2, 4, 5 and 6 in Criminal Complaint Case No. 7354/2010 pending in the Court of Judicial Magistrate First Class, Nagpur. The applicants are the Directors of accused No. 1 M/s. Kerala Sponge Iron Limited. Accused No. 3 is the Managing Director. As far as the applicants are concerned, as I stated that they are accused Nos. 2, 4, 5 and 6 and there are no specific allegations except the averments that they are the Directors of the Company i.e. accused No. 1. In view of the judgment of this Court in the case of Sushanta J. Sarkar and Others Vs. State of Maharashtra and Others, , the prosecution against the applicants will not survive. Hence, I pass the following order.
The prosecution against the applicants pending in the Court of Judicial Magistrate First Class, Nagpur vide Criminal Complaint Case No. 7354/2010 shall stand quashed.
Their bail bonds, if any, shall stand cancelled.
The criminal application accordingly stands disposed of.
