Judgment
Mr. D. Bhattacharjee, learned GA has submitted that if this bench hears this appeal, the respondents will not have any reservation. As agreed by the counsel for the parties, admission of the appeal will be considered on 07.10.2020. On that day, if required, the matter would be heard on merit.
Hence, Mr. D. Bhattacharjee, learned GA is requested to produce the files relating to the appointment of the petitioner and in respect of creation of the post where the petitioner has been appointed.
Mr. Lodh, learned counsel has submitted before us that the petitioner had submitted one leave application in the office of the Additional Public Prosecutor, but the Law Department has returned the said leave application observing that such leave application be filed through the competent authority.
In view of the statement made by Mr. D. Bhattacharjee, learned GA that the person who has been transferred to the post where the petitioner has been working, has joined. The petitioner is permitted to file the leave application directly to the office of Secretary, Law Department by the authority of this order.
A copy of this order for the above purpose be supplied to Mr. S. Lodh, learned counsel in the course of the day.
